If I didn't file my 2008 taxes, which form do I use to file now and do you have any suggestions?

You would still use a Form 1040 (or 1040-EZ or 1040-A, depending on how complex your tax return is).  If you are owed a refund, the IRS statute of limitations for collecting this is three years from the original due date of the return (or April 15, 2012).

 

However, if it turns out that you have a balance due, it is even more important that you file as soon as possible, so as to limit any penalties and interest on the unpaid balance.  

 

Failure to do so will potentially increase the amount owed to the IRS, and may result in actions such as liens, or bank levys.
