I have questions regarding how to file my 2009 taxes. I am married and live in NYC and my husband lives and works in Pennsylvania. I claimed unemployment in New York for 2009 and no state taxes were withheld. Should we be filing our state taxes separatel

ANSWER

The BIDaWIZ Team's Answer:

If you are both NY residents, you must both file a NY return. You may

file jointly, or "married filing separately." Usually, filing jointly will result

in a lower tax liability. If PA taxes were withheld, from your Spouse's compensation,

he must also file a non-resident PA return, to recoup the PA withholdings amount.

If he is a PA resident, you must file "married filing separetely." You will file a NY return,

and he will file a PA return.
