I want to know what counts as North Carolina Gross Receipts for Sales and Use tax purposes. I have a NC registered LLC that has income from sources in NC and overseas. The income is in three categories: sale of good (software and book) - this is a very minor source of income; consulting income from work done for a NC company (this is my major source of income); software development income from a university in Australia. What do I report as NC Gross Receipts?

ANSWER

The BIDaWIZ Team's Answer:

According to Title 17, Chapter 7 of the Administrative Code for North Carolina, consulting services would not be subject to sales or use tax, and software development work would be considered custom software and wouldn't be subject to sales tax either. The sales for the off the shelf software and books would be subject to sales tax as goods based on the information you provided.
