What happens if my wife filed married filing jointly and I wanted to file married filing separately?

ANSWER

The BIDaWIZ Team's Answer:

Your spouse needs to have your consent to file to file as married filing jointly. If they do not have your consent and you file as married filing separately, then their tax return would be considered to contain a forged signature. If there was also not any tacit (implied) consent, then their filing would be considered invalid. This is referenced in Internal Revenue Memo - 25.15.1, Relief from Joint and Several Liability as detailed here.
