My wife and I had a failed adoption in 2014. We paid all adoption fees in 2014 through an adoption agency. The baby was born in August 2014 and after a couple of months the birth father was granted custody in family court. Will we be able to claim the adoption credit when we file our 2014 taxes?

If you paid qualified adoption expenses in an attempt to adopt a U.S. child and the attempt was unsuccessful, treat those expenses in the same manner as expenses you paid for adoptions not final by the end of the year.
