In my divorce the court ordered my ex-husband to pay outstanding fees to the IRS, will my refund be taken from me because he still owes money.

You should be clear subsequent to the divorce proceedings.  If he was ordered by the court to pay the outstanding fees/liability to the IRS that should have removed you from the liability.  At the end of the divorce it should be very clear what you will be entitled to (assets) and what you will be liable for (liabilities).
