We filed incorrect 2009 and 2010 Form 500 for our Marlyand State Corporation. We did not get a tax refund as we were supposed to for those years. So, this year, we filed the 2009 and 2010 Form 500 again in March of 2012 and mailed to Georgia Revenue Dept. Have we acted correctly?

If you filed incorrect Form 500 forms in 2009 and 2010, then yes, you will need to file Amended Corporation Income Tax Returns - 500X Forms for both years.

If I understand you correctly, your wife was retired from the Atlanta VA hospital in 2009. You retired from the CDC on May 31, 2011. For tax years 2009 and 2010 you filed a joint tax returns showing that both you and your wife were full year residents. This was done by using code "1" in box 4. You discovered your error and filed a second Georgia tax return for the same tax years. This time however, you showed a different code in box 4. I can't tell from your question when it was that you and your wife moved to Houston and became non-residents of Georgia. What you should have done was file form 500X for both years and attach an explanation. What you should do at this point is to contact the Georgia Department of Revenue and explain the facts and that you attempted top correct the error by filing a second form 500. When you do either of these you should have all copies of the tax returns (both sets of mailings) and if possible proof of mailing with the date.
