If I am filing for bankruptcy at the end of this month, do I need to file for a new EIN for my sole proprietorship? Also, can I use multiple DBA names for two separate businesses that are under the same EIN?

ANSWER

The BIDaWIZ Team's Answer:

As a sole-proprietor, you are required by the IRS to obtain a New EIN when you become subject to a bankruptcy proceeding. Sole proprietors only have one EIN as they are the business and treated as such for tax purposes. As far as DBAs go, it's a fictitious name and not an actual entity. You can have multiple for separate sole proprietorships. This is referenced in IRS publication 1635 and IRC Section and IRC section 7701
