We own a farming ranch in Concordia, Kansas. We have all sorts of animals and vegetation in our property. We do sell our animals from time to time. The buyer is either another farmer that needs more cattle or chickens that we breed or a local that is looking for a pet. I'm not very sure if we are charging sales tax correctly. Are they all taxable transactions?
ANSWER
The BIDaWIZ Team's Answer:
This is an interesting question as the answer largely depends on the type of buyer. Generally speaking, the sales of agricultural animals and fowl (cattle, chickens, hogs, ostriches, sheep, turkeys, etc.) and aquatic animals and plants are exempt from sales tax.
However, animals purchased for pleasure or pets are subject to sales tax.
