Our company sells a newspaper publication both in hard copy and electronically. Are these subscriptions subject to New York state sales tax?

In New York State, newspapers and periodicals are generally exempt from sales tax. However, in order to be exempt it must be published in printed or written form at stated, short intervals, usually daily or weekly; contain matters of general interest and reports of current events; and be available for circulation to the public; and, not constitute a book, even if successive issues are combined. The aforementioned guidance also applies to electronic versions as long as they contain the same content as in print. This is referenced in New York State tax Law 1115(a)(5).
