I earn 8 hours of paid leave and 4 hours of sick leave bi-weekly while working for the government. I have accumulated 102 hours that I need to use by the end of the year or January 12th 2013. I have the opportunity to donate that leave before I lose it to a deserving individual who is in need of time due to medical reasons and have used all of their leave. Can I take a deduction if I donate the leave (no more than 80 hours can be donated)?

ANSWER

The BIDaWIZ Team's Answer:

If your employer has a bona-fide leave plan, then you can donate your paid leave and sick days to a person for medical purposes. However, you cannot deduct them and treat it as a charitable donation for tax reporting purposes. That income may be excluded for tax reporting purposes, but by no means can you deduct it.
