My husband and I were married in Dec. 2009. He owes previous back taxes from before I met him. How should I file my taxes to not be responsible for his back taxes?

ANSWER

Expert Michael Lim's Answer:

For 2009, you should both should file under the "Married Filing Separate" filing status.

By doing so, you will avoid sharing or creating any joint tax liabilities, and you will also not be liable for his back taxes for years before you were married.

Reference:  IRS Publication 501.
