If you are still legally married as of December 31, 2010, then you can file either status. 

The best thing to do is have a tax professional calculate your tax liability under both scenarios.  If filing jointly ends up being more advantageous (less taxes/greater refund), then you can (hopefully) work out an equitable arrangement to split the results.
