Can a widow file married joint for two years after the spouse has deceased?

ANSWER

The BIDaWIZ Team's Answer:

Yes; the surviving spouse may use the joint return tax rates,

for two tax years following the year of death, of the spouse, but

only if the surviving spouse remains unmarried, and maintains a home,

for a qualified dependent, for the entire tax year [IRC2(a)].
