I overpaid my federal taxes in 2005. However, I did not file a tax return for 2005 until October of 2009. The IRS has just informed me that they cannot refund my overpayment because my return was received more than three years after it was due. I have no

None. Unfortunately, if you filed the return more than 3 years after the due date, the IRS will not
refund the overpayment. If you have an outstanding tax debt, for any other tax years, you can request that
they apply the lost refund against the other tax year's debt. This is done by filing an offer in compromise [OIC].
