I am getting married on 12/12/12. The gentleman whom I am marrying owes back taxes for both federal and state, he is on a payment plan for both. If we file married filing separately for 2012 will I be penalized?

If you file married filing separately, you should not be penalized by the IRS. Please note that you should keep you checking, brokerage, credit card accounts and everything related to finances, separate from your soon to be spouse. By doing so, you'll avoid his liabilities and potentially having your credit impacted too.
