I live in NJ and work in both NJ and NY. I have completed my federal and NJ State return (though it didn't ask me about taxes in any other states so I probably missed a potential refund there) and am having difficulty with my NY state return as my NY W-2 is only filled out with the state wages and taxes but no other information. Do I need to file in NY since I was a non-resident worker? If so, how do I go about this since the remaining information is blank?

ANSWER

The BIDaWIZ Team's Answer:

Since you are a NJ resident, you have to file, & pay taxes, thereto,

on your income from all sources. You do not owe a NY tax, and you

do not have to file a NY return, unless NY taxes were withhled, from

your compensation. If so, you must file a NY non-resident return,

and attach a copy of your NJ return, thereto, and claim a 100% refund,

of the NY taxes that were withheld. Also, contact the payroll department, and instruct

them to only withold NJ taxes, from your pay; regardless of where you work.
