Do we change how we claim our child on taxes due to new custody changes? At first we had joint custody now we have shared. The ORIGINAL custody paper work stated my husband claims the child for earned income and as the child credit too. We've gone to court twice since then to gain the shared custody. The only thing that has changed is the childs living status. All other aspects of the paper work have remained the same. The tax issue was never changed in court and remains how it was the first day the papers were signed. The mother states we have to rotate every other year now.I have asked a tax consultant and she stated as long as we have the paper to back it up we are fine. But the mother states she's had the child more days in the year. BUT my husband makes more financially then her.
