I am buying a new home. I want to know if I qualify for the first time home buyer tax credit. My spouse bought a house in his name while we were married. The house is in his name only. We are still legally married but have been separated from my spouse

The BIDaWIZ Team's Answer:

See IRC 36 of the 2009 "worker, home ownership,  and business

assistance act." You may still qualify for the $4K credit, if you

file married filing separately, or if you get divorced by the end

of the tax year, in which the home is purchased, you may still

qualify for the entire $8K tax credit.
