My fiance and I are looking to purchase a home prior to December 1, 2009. We are interested in the $8,000 credit. However, I currently own a home and my fiance does not. We are intending to put the new home in her name only. Our current wedding is Nov

See IRC 36, of the "worker, home ownership, and business assistance" act, of 2009.

To qualify, neither spouse may have owned a principal residence during the three year

period prior to the date in which the current residence is purchased. One option, is to delay

the marriage, until 2010. Your fiance can close on the house, in 2009, and claim the

credit, on her 2009 tax return, as a single taxpayer. Otherwise, she may file "married filing

separately," and claim half of the credit. This analysis assumes that your fiance' satisfies

all of the eligibility requirements.
