My ex husband pays me my monthly alimony payment out of his business account. Is this legal and will he be able to claim it at the end of the year.

This is a personal expense and should be paid out of a personal banking account. With that said, this isn't your problem. Your ex-husband will have to account for commingling his business and personal expenses.
