I am a grandparent paying child care for my grandchildren. They live with her, but I want to know if I can claim the child care on my 2010 taxes? I live in Illinois, she lives in Texas, and I will have paid for 4 months worth of care when I file 2010 taxes.

ANSWER

Expert Thomas Graham iii's Answer:

Unfortunately I don't believe you will be able to qualify to claim the Child and Dependent Care Credit on your federal income taxes. To qualify, you would need to meet several requirements for your grandchildren to be considered qualified individual or dependent. I believe you meet three out of the four requirements but I don't believe you meet the support test with the given information. To meet the support test, you would need to provide more than half the support for the grandchildren during the given year. Please see IRS Publication 501 for more information on the qualified individual or dependent and IRS Publication 503 for more information on the Child and Dependent Care Credit.
